Oklahoma City Probate Law Attorney

Probate is simply the process of the court transferring the assets from the name of the descendent to the name of that decedent's intended beneficiaries if there is a will, or to the names of the decedent's heirs at law if there is no will. The person responsible for probate process is called an executor, administrator, or personal representative.

At Postic & Bates, our probate lawyers represent people in Oklahoma who have been named executors of a deceased person's estate. We also represent beneficiaries who are upset with the way an executor is distributing the estate and want to be sure their interests are protected. Our probate lawyers handle everything from:

  • Taking an inventory of the assets, handling creditor claims, paying applicable taxes, and distributing the net assets to beneficiaries
  • Monitoring the probate process for the benefit of heirs and, if necessary, getting involved in will contests
  • Our lawyers also defend executors in will contests

Probate in Oklahoma typically costs from $3,000 to $5,000. If contested, probate could be much more expensive. The probate process usually takes four months to a year. If the beneficiaries contest the will, probate can take much longer.

Probate is a public process that allows the public to see what assets a descendent had, and what each beneficiary received. Our lawyers can help you avoid the probate process for your own heirs by doing your estate planning using a trust instead of a will.
